User Agreement

1. General Provisions

1.1. This User Agreement (hereinafter — the "Agreement") governs the relationship between Tourivex (hereinafter — the "Company" or "Platform") and any individual or legal entity (hereinafter — the "User") using the website tourivex.com (hereinafter — the "Website").

1.2. By accessing or using the Website, the User confirms that they have read, understood, and agreed to be bound by this Agreement.

1.3. If the User does not agree with any part of this Agreement, they must immediately stop using the Website.

1.4. The Company reserves the right to update this Agreement at any time. Continued use of the Website after changes are published constitutes acceptance of the updated terms.

2. Subject of the Agreement

2.1. This Agreement defines the rules and conditions for using the Website, including browsing, searching for vehicles, registering an account, submitting booking requests, leaving reviews, and using other available features.

2.2. Tourivex is an online marketplace that connects car rental Suppliers with Users. The terms of car rental services are governed by a separate document — the Terms and Conditions.

3. User Account

3.1. To access certain features of the Website (booking, reviews, personal account), the User may be required to register and create an account.

3.2. When registering, the User agrees to:

provide accurate, current, and complete information;
keep their account information up to date;
maintain the confidentiality of their login credentials;
be solely responsible for all activity under their account.

3.3. The User must immediately notify the Company of any unauthorized use of their account.

3.4. One User may have only one active account. The creation of multiple accounts by the same person is prohibited.

3.5. The Company reserves the right to suspend or delete an account in case of:

violation of this Agreement;
providing false information;
suspicion of fraudulent activity;
prolonged inactivity.

4. Rights and Obligations of the User

4.1. The User has the right to:

use the Website in accordance with this Agreement;
access vehicle listings and submit booking requests;
contact customer support;
leave reviews about Suppliers and vehicles;
delete their account at any time.

4.2. The User undertakes to:

use the Website only for lawful purposes;
provide accurate information when registering and booking;
respect the rights of other Users, Suppliers, and the Company;
not use the Website to distribute spam, malware, or harmful content;
not attempt to gain unauthorized access to other accounts or the Website's systems;
not copy, scrape, or otherwise extract data from the Website without permission;
not use automated tools (bots, scrapers, crawlers) to access the Website.

5. Rights and Obligations of the Company

5.1. The Company has the right to:

modify, suspend, or terminate any part of the Website at any time without prior notice;
moderate, edit, or remove any content posted by Users;
restrict or terminate access to the Website for Users who violate this Agreement;
collect and process User data in accordance with the Privacy Policy;
send service notifications, booking confirmations, and (with consent) marketing communications.

5.2. The Company undertakes to:

ensure the Website operates in accordance with this Agreement;
protect User data in accordance with applicable laws;
provide customer support during business hours.

6. Prohibited Activities

The User is strictly prohibited from:

6.1. Using the Website for any illegal, fraudulent, or harmful purpose.

6.2. Posting content that is offensive, defamatory, discriminatory, obscene, or violates the rights of third parties.

6.3. Impersonating another person or entity.

6.4. Interfering with the normal operation of the Website (DDoS attacks, malware injection, vulnerability exploitation, etc.).

6.5. Collecting personal data of other Users without their consent.

6.6. Using the Website to advertise third-party services without prior written consent of the Company.

6.7. Reverse-engineering, decompiling, or attempting to extract the source code of the Website.

7. User Content

7.1. The User is solely responsible for any content they post on the Website (reviews, comments, photos, etc.).

7.2. By posting content, the User grants the Company a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content for the purposes of operating and promoting the Website.

7.3. The User confirms that any content they post does not violate the rights of third parties (copyright, trademark, privacy, etc.).

7.4. The Company reserves the right to remove any content that violates this Agreement without prior notice.

8. Intellectual Property

8.1. All content on the Website (design, logos, texts, images, software, databases) is the property of Tourivex or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2. The User is granted a limited, non-exclusive, non-transferable license to access and use the Website for personal, non-commercial purposes only.

8.3. Any unauthorized use of the Website's content is strictly prohibited and may result in legal action.

9. Privacy and Personal Data

9.1. The Company collects and processes personal data of Users in accordance with the Privacy Policy and applicable laws of the United Arab Emirates.

9.2. By using the Website, the User consents to the collection, storage, and processing of their personal data for the purposes of providing services, improving the Platform, and communicating with the User.

9.3. The User has the right to access, correct, or delete their personal data by contacting the Company.

10. Third-Party Links and Services

10.1. The Website may contain links to third-party websites or services (Suppliers, payment systems, social media, etc.).

10.2. The Company is not responsible for the content, accuracy, or practices of third-party websites.

10.3. The use of third-party services is governed by their own terms and policies.

11. Disclaimer of Warranties

11.1. The Website is provided "as is" and "as available" without any warranties, express or implied.

11.2. The Company does not guarantee that:

the Website will operate without interruptions or errors;
all information on the Website is accurate, complete, or up to date;
the Website is free from viruses or other harmful components.

11.3. The User uses the Website at their own risk.

12. Limitation of Liability

12.1. To the maximum extent permitted by law, the Company is not liable for:

any direct, indirect, incidental, or consequential damages arising from the use of the Website;
loss of data, profits, or business opportunities;
actions or omissions of Suppliers, other Users, or third parties;
technical failures, internet outages, or force majeure events.

12.2. The total liability of the Company to any User shall not exceed the amount of service fees actually paid by that User during the 6 months preceding the claim.

13. Termination

13.1. The User may terminate this Agreement at any time by deleting their account and ceasing the use of the Website.

13.2. The Company may terminate or suspend the User's access to the Website at any time, with or without cause, and with or without notice.

13.3. Upon termination, all rights granted to the User under this Agreement immediately cease.

14. Force Majeure

14.1. The Company is not liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, internet outages, cyberattacks, or technical failures of third-party providers.

15. Dispute Resolution

15.1. Any disputes arising out of or in connection with this Agreement shall first be resolved through good-faith negotiations.

15.2. If no agreement is reached, disputes shall be settled in the courts of Dubai in accordance with the laws of the United Arab Emirates.

16. Final Provisions

16.1. This Agreement constitutes the entire agreement between the User and the Company regarding the use of the Website.

16.2. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3. The Company's failure to enforce any provision of this Agreement does not constitute a waiver of that provision.
