1. General Provisions

1.1. This document is a public offer of Tourivex (hereinafter — the "Platform" or "Company"), an online marketplace operating through the website tourivex.com (hereinafter — the "Website"), which connects car rental providers (hereinafter — "Suppliers") with users seeking to rent vehicles (hereinafter — "Clients" or "Users").

1.2. Tourivex is not a car rental company and does not own, lease, or operate any vehicles listed on the Website. The Platform acts solely as an intermediary that facilitates communication and transactions between Suppliers and Clients.

1.3. By using the Website, the User fully and unconditionally accepts the terms of this Agreement.

1.4. The Company reserves the right to modify these Terms at any time. The current version is always available on the Website.

2. Subject of the Agreement

2.1. The Platform provides Users with access to a catalog of vehicles offered for rent by independent third-party Suppliers.

2.2. The Platform's services include:

displaying vehicle listings provided by Suppliers;
enabling Users to search, compare, and submit booking requests;
transferring booking requests to the relevant Supplier;
providing customer support related to the use of the Platform.

2.3. The actual rental agreement is concluded directly between the Client and the Supplier. Tourivex is not a party to that agreement.

3. How the Platform Works

3.1. The User selects a vehicle on the Website and submits a booking request.

3.2. The request is forwarded to the Supplier, who confirms availability and the final terms of the rental.

3.3. After confirmation, the Client and the Supplier enter into a direct rental agreement governed by the Supplier's own terms and conditions.

3.4. All matters relating to vehicle handover, return, condition, insurance, deposit, fines, and disputes are settled directly between the Client and the Supplier.

4. Role and Responsibility of Tourivex

4.1. Tourivex acts solely as a technology platform and information intermediary.

4.2. Tourivex does not:

own or operate vehicles;
provide rental services directly;
guarantee the accuracy of listings provided by Suppliers;
guarantee the condition, legality, or quality of the vehicles;
act as an insurer or guarantor of any transaction.

4.3. Tourivex is not liable for:

the actions or omissions of Suppliers or Clients;
the condition, safety, or legal status of the vehicles;
accidents, damage, fines, or losses occurring during the rental;
disputes between Clients and Suppliers;
failure of the Supplier to fulfill its obligations;
failure of the Client to fulfill its obligations toward the Supplier.

4.4. Tourivex reserves the right to assist in dispute resolution as a goodwill gesture, but is not legally obligated to do so.

5. Obligations of the User (Client)

5.1. The User undertakes to:

provide accurate and truthful information when making a booking;
comply with the terms and conditions of the selected Supplier;
comply with the traffic regulations of the United Arab Emirates;
meet the requirements of the Supplier (age, driving license, deposit, etc.);
settle all matters related to the rental directly with the Supplier.

5.2. The User acknowledges that all rental terms (deposit, insurance, fuel policy, mileage limits, fines, cancellation rules, etc.) are set by the Supplier and may vary.

6. Obligations of the Supplier

6.1. By listing vehicles on the Platform, the Supplier confirms that:

it is duly licensed to provide car rental services in the United Arab Emirates;
all vehicles listed are properly registered, insured, and roadworthy;
the information provided in the listings is accurate and up to date;
it complies with all applicable laws and regulations of the UAE.

6.2. The Supplier bears full responsibility for the rental services it provides to Clients.

7. Booking and Payment

7.1. Depending on the Supplier's terms, payment may be made:

directly to the Supplier upon vehicle handover;
through the Platform (where available);
partially as a prepayment via the Website, with the balance paid to the Supplier.

7.2. The Platform may charge a service fee, which is included in the displayed price or shown separately at checkout.

7.3. Refunds, cancellations, and chargebacks are handled in accordance with the Supplier's policy and applicable payment processor rules.

8. Cancellation and Refunds

8.1. Cancellation policies are set individually by each Supplier and are displayed on the corresponding vehicle's page.

8.2. The User is responsible for reviewing the cancellation policy before confirming a booking.

8.3. Tourivex does not refund payments made directly to Suppliers and is not responsible for the Supplier's refund decisions.

9. Reviews and User Content

9.1. Users may leave reviews and ratings about Suppliers and vehicles after a completed rental.

9.2. Reviews must be truthful, lawful, and free from offensive, discriminatory, or misleading content.

9.3. Tourivex reserves the right to moderate, edit, or remove any user-generated content at its sole discretion.

10. Intellectual Property

10.1. All content on the Website (logos, design, texts, software) is the property of Tourivex or its licensors and is protected by copyright and trademark laws.

10.2. Users may not copy, reproduce, or distribute any part of the Website without prior written consent of the Company.

11. Privacy and Data Protection

11.1. The Company processes personal data in accordance with its Privacy Policy and applicable laws of the United Arab Emirates.

11.2. By using the Website, the User consents to the transfer of necessary booking information to the relevant Supplier.

12. Limitation of Liability

12.1. To the maximum extent permitted by law, Tourivex's total liability to any User shall not exceed the amount of service fees actually paid by that User to the Platform during the 6 months preceding the event giving rise to the claim.

12.2. Tourivex is not liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, data, or business opportunities.

13. Force Majeure

13.1. The Parties are released from liability for failure to fulfill obligations in the event of force majeure (natural disasters, government actions, military operations, internet outages, etc.).

14. Dispute Resolution

14.1. Disputes between Users and Suppliers are resolved directly between them.

14.2. Disputes between Users and Tourivex are resolved through negotiations. If no agreement is reached, disputes are settled in the courts of Dubai in accordance with the laws of the United Arab Emirates.
